These Terms of Service (“Terms”) govern your access to and use of the Jin Actual website, online store, products, and related services.

Throughout these Terms, “Jin Actual,” “we,” “us,” and “our” refer to Jin Actual. “You” and “your” refer to any person who visits our website, creates an account, communicates with us, or purchases our products.

By accessing our website or placing an order, you agree to these Terms and to the policies incorporated into them, including our Shipping Policy, Return and Refund Policy, and Privacy Policy. Do not use the website or place an order if you do not agree to these Terms.

1. Eligibility

You must be at least the age of legal majority in your jurisdiction to make a purchase from Jin Actual. A person who has not reached the age of legal majority may use the website only with the involvement and permission of a parent or legal guardian.

By placing an order, you represent that:

• The information you provide is accurate and complete.
• You are authorized to use the selected payment method.
• Your purchase is lawful in your location.
• You are purchasing for legitimate personal or authorized business purposes.

2. Online Store Services

Jin Actual operates an online retail store offering apparel, footwear, accessories, bags, headwear, and other merchandise.

We may add, remove, modify, suspend, or discontinue products or website features at any time. We do not guarantee that every product, color, design, size, or variation will remain available.

3. Made-to-Order and Third-Party Fulfillment

Many Jin Actual products are made or prepared after an order is placed. Products may be manufactured, printed, assembled, packaged, stored, or shipped by independent production and fulfillment partners.

These partners may operate from facilities located in different states or countries. The shipping origin shown on a package may therefore differ from Jin Actual’s business address.

The use of third-party manufacturers, fulfillment providers, payment processors, and carriers does not change the fact that Jin Actual is the customer-facing seller. Questions, complaints, return requests, and order problems should be directed to Jin Actual rather than directly to a manufacturer unless we instruct you otherwise.

4. Product Information

We attempt to present product descriptions, photographs, colors, dimensions, materials, and other information as accurately as reasonably possible. However, we cannot guarantee that all information will always be complete, current, or error-free.

The appearance of a product may vary slightly because of:

• Screen and display settings.
• Lighting and photography.
• Printing or embroidery processes.
• Fabric or material characteristics.
• Production batches.
• Manufacturing tolerances.
• Placement or alignment variations.

Reasonable production variation is not automatically considered a defect. This provision does not exclude products that are materially damaged, defective, misprinted, or substantially different from what was ordered.

5. Sizes and Fit

Sizing may vary by product, manufacturer, cut, and material. Some products may fit substantially slimmer or differently than conventional retail sizing.

You are responsible for reviewing:

• The product-specific size chart.
• Listed garment measurements.
• Fit notices.
• Recommendations shown on the product page.
• Any “runs small,” “runs slim,” “oversized,” or similar disclosure.

Sizing recommendations are general guidance and are not a guarantee that a particular size will fit every customer.

Returns or exchanges involving size or fit are governed by our Return and Refund Policy.

6. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the selected products. An automated order confirmation acknowledges that we received the order but does not necessarily mean that the order has been finally accepted or entered into production.

We may refuse, limit, place on hold, or cancel an order for legitimate reasons, including:

• Product or supplier unavailability.
• Manufacturing limitations.
• Incorrect pricing or product information.
• Payment failure.
• Suspected fraud or unauthorized activity.
• Unusual order quantities.
• Delivery restrictions.
• Legal or regulatory requirements.
• Violation of these Terms.
• Technical or system errors.

When we cancel an order after payment has been collected, we will issue an appropriate refund for the canceled portion of the order.

We may limit quantities purchased per person, household, account, payment method, billing address, shipping address, or order.

7. Order Changes and Cancellations

Because many products are made after purchase, production may begin shortly after an order is submitted.

Requests to change or cancel an order must be sent to us as soon as possible. Changes may include:

• Product selection.
• Size.
• Color.
• Quantity.
• Shipping address.
• Cancellation of an item or order.

We do not guarantee that a requested change or cancellation can be completed. Once an order or item has entered production, it may no longer be possible to modify or cancel it.

Failure to review an order before submission does not guarantee eligibility for cancellation, refund, or replacement.

8. Prices and Payment

Prices are displayed in the currency indicated on the website or during checkout. Prices may change without advance notice, but price changes will not ordinarily affect an order that has already been accepted.

You agree to pay:

• The listed product price.
• Applicable shipping charges.
• Applicable sales or similar taxes.
• Any other charges clearly disclosed before checkout.

You authorize Jin Actual and its payment-service providers to charge the payment method submitted with your order.

We may correct pricing, description, discount, or calculation errors. When a material error affects an order, we may contact you for instructions or cancel the affected item and issue a refund.

9. Taxes, Duties, and International Charges

Taxes may be calculated according to the information available during checkout and applicable legal requirements.

International orders may be subject to:

• Customs inspections.
• Import duties.
• Tariffs.
• Brokerage charges.
• Local taxes.
• Administrative fees.
• Destination-country restrictions.

Unless otherwise stated during checkout or required by law, the recipient is responsible for charges imposed by the destination country or carrier. Jin Actual does not control these charges and may not be able to estimate them in advance.

Refusal to pay customs or import charges may cause a package to be delayed, abandoned, destroyed, or returned. Any resulting refund or reshipment request will be handled according to our Shipping Policy and Return and Refund Policy.

10. Production, Shipping, and Delivery

Jin Actual products are created fresh through our manufacturing and fulfillment network after an order is placed.

Please allow approximately 4 to 6 weeks for production, shipping, and delivery. Orders frequently arrive sooner, and many are ordinarily received within approximately two weeks, but the shorter timeframe is not guaranteed.

Production time and carrier transit time are separate. Delivery estimates may be affected by:

• Product availability.
• Manufacturing volume.
• Carrier delays.
• Weather.
• Holidays.
• Customs processing.
• Incorrect addresses.
• Service interruptions.
• Events outside our reasonable control.

If we cannot ship within the timeframe promised or otherwise required by applicable law, we will provide notice and any delay, cancellation, or refund options required by law.

Additional shipping terms are contained in our Shipping Policy, which is incorporated into these Terms.

11. Separate Packages and Partial Shipments

Products in the same order may be manufactured or fulfilled by different facilities.

As a result:

• Items may be compiled, packaged, and shipped separately.
• Packages may leave their facilities on different dates.
• Each shipment may have a separate carrier or tracking number.
• Items may arrive on different dates.
• A package containing only part of an order does not necessarily mean that the remaining items are missing.

Shipping charges displayed at checkout may account for multiple fulfillment locations even when the customer completes one transaction.

12. Customer Shipping Information

You are responsible for providing a complete and accurate shipping address, including any apartment, suite, building, unit, postal code, access code, or other necessary delivery information.

Contact us immediately after ordering if you discover an address error. Address changes are not guaranteed after production or fulfillment begins.

Additional charges may apply when a package must be:

• Redirected.
• Corrected.
• Reproduced.
• Reshipped.
• Recovered after being returned to sender.

Jin Actual is not responsible for delivery failure caused solely by inaccurate or incomplete information supplied by the customer, subject to applicable law.

13. Tracking and Delivery Problems

Tracking information may not update immediately after a label is created. Carrier scans and estimated delivery dates are controlled by the carrier.

When tracking shows that a package was delivered but you cannot locate it, you should promptly:

• Check the delivery location and surrounding property.
• Ask household members or authorized recipients.
• Check with neighbors, building management, reception, or a mailroom.
• Review carrier photographs or delivery notes when available.
• Contact Jin Actual within the reporting period stated in our Shipping Policy.

We may require reasonable cooperation and documentation before approving a replacement or refund for a package reported missing.

The treatment of lost, stolen, misdelivered, refused, or returned packages is governed by our Shipping Policy and applicable law.

14. Returns, Exchanges, and Refunds

Returns, exchanges, replacements, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

Eligibility may depend on:

• The reason for the request.
• The date of delivery.
• The date the problem was reported.
• The condition of the product.
• Whether the item was used, worn, washed, altered, or damaged.
• Whether the product was made to order or designated final sale.
• Whether the issue involves customer preference or a verified fulfillment error.

Customer-preference requests, including buyer’s remorse, an incorrectly selected size, or an incorrectly selected color, may be treated differently from verified damage, defects, misprints, missing products, or incorrect products.

Refunds are ordinarily issued to the original payment method unless otherwise stated or agreed. Financial institutions may require additional time to post a processed refund.

15. Damaged, Defective, Incorrect, or Missing Products

Contact Jin Actual promptly if an order arrives damaged, defective, materially misprinted, incomplete, or incorrect.

We may request:

• Your order number.
• A written description of the issue.
• Photographs of the entire product.
• Close-up photographs of the problem.
• Photographs of labels or packaging.
• Additional information reasonably required to investigate the claim.

Do not return a product directly to a manufacturer or to the address printed on a package unless Jin Actual provides return instructions.

Depending on the circumstances, an approved claim may result in a replacement, refund, store credit, repair, or another remedy permitted by our policies and applicable law.

16. Promotions and Discount Codes

Promotional offers may be subject to separate conditions, including:

• Start and expiration dates.
• Product exclusions.
• Geographic limitations.
• Minimum purchase amounts.
• Customer eligibility requirements.
• Quantity limitations.
• Restrictions on combining discounts.

Unless expressly stated otherwise:

• Only one discount code may be used per order.
• Discounts have no cash value.
• Discounts cannot be applied retroactively.
• Expired promotions will not be honored.
• Promotional pricing may be changed or withdrawn before an order is placed.

We may cancel orders or promotional benefits arising from obvious errors, fraud, manipulation, unauthorized duplication, or misuse.

17. Accounts and Account Security

You may be permitted to create a customer account. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You agree to provide accurate account information and promptly update it when necessary.

Notify us promptly if you believe that your account or payment information has been used without authorization. We may suspend or restrict an account while investigating suspected misuse or security concerns.

18. Acceptable Use

You may not use our website or services to:

• Commit or facilitate fraud.

• Abuse return, refund, promotion, or chargeback systems.

We may restrict access, cancel orders, or terminate accounts associated with prohibited conduct.

19. Intellectual Property

The Jin Actual name, logos, designs, product graphics, website layout, photographs, written content, slogans, and other original materials are owned by or licensed to Jin Actual and are protected by applicable intellectual-property laws.

You may use the website for personal, noncommercial shopping purposes. You may not reproduce, distribute, modify, sell, license, publish, or commercially exploit our materials without prior written permission.

Third-party names, trademarks, and service marks remain the property of their respective owners.

20. Reviews, Photographs, and Customer Submissions

You may submit reviews, feedback, photographs, comments, or other content where the website permits.

You retain ownership of your original submission. By submitting content to Jin Actual, you grant us a nonexclusive, worldwide, royalty-free license to display, reproduce, format, and use that content for operating, improving, and promoting our business, subject to applicable law and any privacy choices communicated to you.

You may not submit content that is:

• Knowingly false or misleading.
• Unlawful.
• Defamatory.
• Threatening or harassing.
• Infringing.
• Fraudulent.
• Malicious.
• Unrelated spam.
• Containing private information you are not authorized to disclose.

Nothing in these Terms prohibits or penalizes you for providing an honest review, criticism, or assessment of Jin Actual, its products, or its services.

21. Third-Party Services and Links

Our website may rely on or link to third-party services, including:

• Shopify.
• Manufacturers.
• Fulfillment providers.
• Payment processors.
• Shipping carriers.
• Analytics providers.
• Advertising services.
• Social-media platforms.

Third-party services may be governed by their own terms and privacy practices. We are not responsible for unrelated content or activities on third-party websites.

Nothing in this section eliminates Jin Actual’s responsibilities as the seller or limits any nonwaivable customer right.

22. Privacy

Our collection, use, storage, and disclosure of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be processed by service providers that assist with payment, fraud prevention, production, fulfillment, delivery, analytics, communications, and website operation.

The Privacy Policy is incorporated into these Terms.

23. Product Safety and Recalls

We may remove a product, suspend sales, contact affected customers, cancel orders, provide corrective instructions, issue refunds or replacements, or cooperate with manufacturers and government authorities when a safety concern or recall arises.

You agree to follow reasonable product-safety and recall instructions communicated by Jin Actual.

Nothing in these Terms limits rights or remedies related to an unsafe or legally noncompliant product.

24. Disclaimer of Warranties

To the fullest extent permitted by law, the website and products are provided on an “as available” basis, except for express warranties specifically provided in writing.

We do not guarantee that:

• The website will always operate without interruption.
• Every product will remain available.
• Website content will always be error-free.
• A product will satisfy every personal preference.
• Colors will appear identically on every display.
• Delivery will occur on an estimated date.

This section does not exclude express product promises, statutory warranties, or consumer rights that cannot legally be waived.

25. Limitation of Liability

To the fullest extent permitted by law, Jin Actual will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or purchase of a product.

Where liability may lawfully be limited, Jin Actual’s total liability arising from a particular order will not exceed the amount paid to Jin Actual for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude liability for fraud, willful misconduct, gross negligence, personal injury, or any right or remedy that cannot legally be limited.

26. Indemnification

To the extent permitted by law, you agree to be responsible for losses, liabilities, and reasonable expenses resulting from your unlawful use of the website, fraudulent activity, infringement of another party’s rights, or material violation of these Terms.

This provision does not require a consumer to indemnify Jin Actual for Jin Actual’s own negligence, unlawful conduct, or breach of duty.

27. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, natural disasters, carrier interruptions, labor disputes, war, civil unrest, epidemics, government action, customs disruption, telecommunications failure, supplier shutdowns, or widespread technical outages.

This section does not eliminate any cancellation, delay-notice, refund, or other obligation imposed by applicable consumer law.

28. Suspension and Termination

We may suspend or terminate access to the website, close an account, refuse future orders, or cancel a pending order when reasonably necessary because of:

• Fraud or suspected fraud.
• Unauthorized payment activity.
• Repeated policy abuse.
• Harassment or threats.
• Illegal conduct.
• Security risks.
• Material violation of these Terms.

When an unfulfilled paid order is canceled, we will provide any refund required under our policies and applicable law.

29. Governing Law and Disputes

These Terms are governed by the laws of Pennsylvania, without regard to conflict-of-law principles, except where the mandatory consumer laws of another jurisdiction apply.

Before filing a legal claim, you and Jin Actual agree to make a reasonable good-faith effort to resolve the matter by contacting the other party and describing the dispute and requested resolution.

Unless applicable law provides otherwise, legal proceedings relating to these Terms or a purchase from Jin Actual shall be brought in the courts located in Pennsylvania.

Nothing in this section prevents either party from using an eligible small-claims court or exercising any nonwaivable statutory right.

30. Changes to These Terms

We may revise these Terms to reflect changes in our operations, products, services, suppliers, legal obligations, or business practices.

The revised Terms will be posted with an updated “Last Updated” date. Material changes will apply prospectively unless applicable law permits otherwise.

The Terms in effect when an order is placed will generally govern that transaction, except where a later change is required by law or accepted by both parties.

31. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

32. No Waiver

A delay or failure by Jin Actual to enforce a provision does not permanently waive that provision or any other right.

A one-time customer-service exception does not amend these Terms or require the same exception in another case.

33. Entire Agreement and Policy Priority

These Terms and the policies incorporated into them constitute the agreement between you and Jin Actual concerning use of the website and purchases from the store.

When a specific subject is addressed by a separate policy, the more specific policy controls that subject. For example:

• The Shipping Policy controls shipping procedures.
• The Return and Refund Policy controls return eligibility.
• The Privacy Policy controls personal-information practices.

Nothing in these Terms or our policies limits rights that cannot legally be waived.
